President picks Sotomayor as his judge with empathy

President Obama has made his pick for the Supreme Court – Sonia Sotomayor.

He has stated he would choose someone with empathy.

“I will seek someone who understands that justice isn’t about some abstract legal theory or footnote in a casebook; it is also about how our laws affect the daily realities of people’s lives, whether they can make a living and care for their families, whether they feel safe in their homes and welcome in their own nation,” Mr. Obama said.

During his campaign, he even went so far as to say:

“We need somebody who’s got the heart, the empathy, to recognize what it’s like to be a young teenage mom, the empathy to understand what it’s like to be poor or African-American or gay or disabled or old — and that’s the criterion by which I’ll be selecting my judges.”

According to Title 28, Chapter I, Part 453 of the United States Code, each Supreme Court Justice takes the following oath:

“I, [NAME], do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as [TITLE] under the Constitution and laws of the United States. So help me God.”

I don’t see anything about empathy in there.  And what about that blindfolded lady?  I always thought it was empathy/sympathy that a judge was supposed to set aside and make their judgments based on the law.  If judgments were made out of feelings and emotion there would never be a foreclosure, never a collection of a debt, never even a divorce, and never a person jailed or imprisoned.  There are always consequences to lawful judgments and all impact lives in the end.  Empathy is for a counseling session not a court of law.

“Empathy and sympathy are very close and are sometimes used as synonyms. The easiest way to separate them is to remember that empathy is about feelings whilst sympathy is about actions. Thus you may empathize with another person and then act on this by telling them how sorry or happy you feel for them.”

“Empathetic people are often very sympathetic – they can hardly stop themselves as they really do feel for the other person.”

    60% of her rulings have been overturned by the Supreme Court but I am sure she s a lovely woman and empathizes with the Right Kind of People/sarc 🙂

    Well, if a judge has empathy for one side it means the other side is flat out of luck.

    For example, what if you are owner of a rental property and the renters have not paid any rest in say six months because you already had empathy for them. But now the judge won’t evict them because the poor family will be out in the streets. Never mind that now the property owner is out money and can’t pay their mortgage or pay for maintenance of the building and the grounds. It just won’t work.

  3. Bella, there are a group of people who don’t think- they just feel. They don’t ever think past their noses, they never think about actions and consequences. It all is about how it makes them feel in the moment, and they want to feel good about themselves. My daughter has a theory, that everything that is not working for people, all the issues they can’t get past, can be traced back to low self esteem. It is a form of conditioning but this country has turned the once self sufficient into a bunch of interdependent victims. It isn’t an accident, that they model the co dependent disease…just saying co dependents are probably attracted to collectivism it re affirms their disease. If anyone ever did a study of online trolls, I wonder what the main underlying mental issues, they would be diagnosed with?

    Laura makes many good points, Clarence Thomas’s personal story was not of any concern to the Democrats who grilled him…maybe filleted him is the right description.

    She (Sotomayer) has the right probably political out look for them, and so her personal story is going to be highlighted, and sold, and resold, and retold, and she is going to be an inspiration to Latinas and Latinos. And yet Justice Thomas, and Justice Miguel Estrada, weren’t any such inspiration so they were fair game for ridicule and disparagement.

    Ridicule and disparagement – If we could have a discussion on the issues, that would be one thing, but the playing field is not level. The double standard reigns and isn’t that what the country is supposed to be about, equal treatment under the law. I’m okay with giving some advantage to the disadvantaged, but not at the expense of fairness to everybody. It is blatantly unfair to just throw a test out just because only whites passed. I am sure Ms. Sotomayor is a fine judge, don’t know that much about her, and her career cannot be rolled up in one statement or one judgment, but they don’t play fair. Just look at the treatment women and minorities have been subjected to simply because they have different views. So it’s not at all about black, hispanic, white, black, it’s just all about who is going to promote the agenda.

    And about the troll population, they are just beyond words. I read somewhere that a psychological study was done on the vicious trolls and they found they were either bedwetters or impotent or both. 🙂

    I think they only use the under privileged – the disadvantaged. People kept pointing to south Chicago during the campaign – where Obama was a community organizer it didn’t get any better with Obama’s attention. It’s about power, they really don’t want to raise the under class up, they want to manage them like on a huge Government Plantation. Through dependency, it undermines the poor their right to self determination – natural law. Take a look at who has really benefited from the stimulus bill? It isn’t turning out to have been very helpful. Michigan is getting .21 per citizen but North Dakota, that doesn’t have the same high unemployment gets 26.00. So how many people in Detroit, that got laid off, and fired really benefited from the stimulus? But I bet they voted for Obama. Someone is getting paid off for political favors. I only see the poor suffering more and more. California is slashing their budget. Arnold said, that meant Welfare was getting cut. Who is on Welfare right now in California, who voted for Obama because of you know hope and change…..happy cows come from California…..well they need to come up with a new slogan, I don’t think they are all that happy anymore 🙂 Maybe: Sour Grapes come from California 🙂
